公益財団法人現代芸術振興財団（以下、「当財団」）は、当財団の運営する事業のご利用者様、お取引先様、採用応募者様、及び役職員（退職者を含む。以下総称して「ご本人」）の個人情報のお取扱いについて下記の通り定めます。

１．個人情報の利用目的

当財団は、以下の目的で、ご本人の個人情報を利用します。

  • （１）当財団の事業の案内、提供および管理
  • （２）当財団の事業に関するアンケートの実施
  • （３）各種イベント、運営、管理および各種情報の提供
  • （４）当財団の事業に関する連絡
  • （５）お問い合わせ、依頼等への対応
  • （６）採用応募者様の個人情報
    ・採用選考手続き、面接等の日程調整・連絡、及び採用合否判定の通知のため
  • （７）お問い合わせ、依頼等への対応
    ・労務管理、給与・賞与等の支払い、社会保険・労働保険関連の手続き、および福利厚生の提供のため
    ・業務連絡、安全衛生管理、災害時等の緊急連絡、および当財団内における役職名等の開示のため
    ・退職後の各種手続き、連絡、及び在職中における人事労務データ保管のため
２．取得する個人情報

当財団は、前項に定める利用目的を達成するため、下記のご本人の個人情報を、適正かつ公正な手段によって取得します。

  • （１）当財団の事業の案内、提供および管理
    氏名、住所、電話番号、Eメールアドレス、送付先等
  • （２）当財団へのお問い合わせやご意見の内容
    ご本人とのやり取りの中に含まれる情報、お問い合わせ・ご要望・ご意見の内容（それらの原因や解決方法を含む）等
  • （３）当財団ウェブサイトのご利用状況を含むIT・システムデータ
    クッキーやウェブサイト上の行動ログ等を含むご本人が当財団ウェブサイトをどのようにご利用になったかについての情報等
３．第三者への開示・提供

当財団は、ご本人の個人情報を第三者へ開示または提供することはありません。なお、業務委託により提供する場合は、第三者への開示または提供には該当しません。

４．共同利用

当財団は、ご本人の個人情報を共同利用しません。

５．個人情報の管理

当財団は、ご本人の個人情報をお預かりするにあたり、適切な管理を行うとともに、漏洩、紛失、改ざん等の防止のために最大限の注意を払っています。

６．個人情報の取扱いに関する請求

当財団は、当財団が保有するデータベースに保持されるご本人の個人情報について、ご本人から、開示、訂正、削除、追加、利用停止、消去（以下、「開示等」）のいずれかに関するご請求を頂いた場合、請求された方がご本人であることを確認の上で、合理的な期間および範囲で、法令に従い対応します。
開示等の際の方法は、書面または電磁的記録等、ご本人のご希望をお伺いいたします。利用目的の通知及び開示に際しては、手続きに要する実費（郵送代等）をご負担いただきますので、予めご了承ください。なお、ご請求が法令の定める要件を満たさない場合、または、法令により、開示等を拒絶することが認められる事由がある場合には、お申出に添えないことがございます。

EEAプライバシーポリシー

EEAプライバシーポリシーでは、EU一般データ保護規則2016/679（以下、「GDPR」）に基づく、欧州経済領域（以下、「EEA」）に所在するご本人の個人情報の取扱いについて、説明いたします。
なお、プライバシーポリシーで規定する内容とEEAプライバシーポリシーで規定する内容が抵触する場合には、EEAプライバシーポリシーの規定が優先するものとします。

１．個人情報の取扱いの法的根拠

当財団はGDPRに基づき、ご本人の個人情報を、特定の目的（プライバシーポリシー第1項に記載）のために必要な範囲内でのみ取扱うことにより保護しています。

当財団は、ご本人の個人情報を以下のいずれかの法的根拠に基づいて取扱います。
  • （1）ご本人が取扱いに同意した場合
  • （2）契約の履行または契約締結のための措置を講じるために必要な場合
    これは通常、ご本人の本人情報、連絡先等、当財団が事業を運営するために必要なご本人の情報を取扱う根拠となります。
  • （3）当財団が法的義務を遵守するために取扱う必要がある場合
    これには、法執行機関等との個人情報の共有や、ご本人や当財団の従業員に対する法的義務等が含まれます。
  • （4）ご本人または第三者の生命を保護するために必要な場合
  • （5）個人データの取扱いが当財団または第三者の正当な利益の目的のために必要となり、これらの利益にデータ保護法に基づくご本人の権利が優先するものでない場合
    これには、当財団の事業を運営するために必要な個人情報の利用はもちろんのこと、当財団のサービスの維持・開発・改善が含まれます。
２．個人情報の取扱いに関する請求

ご本人は、当財団が取得し処理する個人情報について、以下の法的権利を有しています。これらの権利を行使される場合には、下記のお問い合わせ窓口までお問い合わせ下さい。

  • （1）開示請求
  • （2）訂正・更新の請求
  • （3）削除請求
  • （4）個人情報の転送
  • （5）取扱いに対する異議申立て
  • （6）個人情報の利用方法の制限
  • （7）同意を撤回する権利
上記の権利は絶対的なものではなく、すべての状況に適用されるわけではありませんのでご留意ください。また、状況によっては、法律上の例外規定が適用される場合があり、そのような場合にはご請求をお断りする場合もあります。
３．個人情報の共有

当財団は第三者との間で個人情報を共有いたしません。

４．ダイレクト・コミュニケーション

当財団では、ご本人にニュースや事業の詳細をお知らせするために、随時情報を配信しています。ご本人が情報の受領を希望されない場合は、下記のお問い合わせ窓口までご連絡下さい。

5．個人情報の保管場所

当財団は日本に所在しております。日本は、欧州委員会から個人情報の保護が十分になされているとして認定を受けております。

6．個人情報の保存期間

当財団は、個人情報を、その取得・処理目的を達成するために必要な期間に限り保持します。具体的な保持期間は、個人情報の取得・処理目的、個人情報の性質、法律上または業務上の個人情報保持の必要性を考慮して決定されます。

7．監督機関への不服申立て

ご本人は、ご本人に関連する個人情報の処理につき、ご本人の居住地を管轄するデータ保護当局に対して異議を申し立てる権利を有します。

The Contemporary Art Foundation (hereinafter referred to as "the Foundation") hereby establishes the following policy regarding the handling of personal information of users of the services operated by the Foundation, business partners, job applicants, and executives and employees (including retirees; hereinafter collectively referred to as "the Individual").

1. Purpose of Use of Personal Information

The Foundation shall use the Individual's personal information for the following purposes:

  • (1) Guidance, provision, and management of the Foundation's operations and services.
  • (2) Conducting questionnaires and surveys regarding the Foundation's operations and services.
  • (3) Operation, management, and provision of information for various events.
  • (4) Communications regarding the Foundation's operations and services.
  • (5) Responding to inquiries, requests, etc.
  • (6) Personal information of job applicants:
    For recruitment selection procedures, scheduling and contacting for interviews, and notification of employment decisions.
  • (7) Personal information of executives and employees (including retirees):
    ・For labor management, payment of salaries/bonuses, procedures related to social insurance and labor insurance, and provision of welfare benefits.
    ・For business communication, safety and health management, emergency contact during disasters, and disclosure of official titles within the Foundation.
    ・For various procedures and communications after retirement, and retention of personnel and labor data during employment.
2. Collection of Personal Information

In order to achieve the purposes of use specified in the preceding section, the Foundation shall acquire the following personal information of the Individual through proper and fair means:

  • (1) Guidance, provision, and management of the Foundation's operations and services:
    Name, address, telephone number, email address, shipping address, etc.
  • (2) Contents of inquiries and feedback to the Foundation:
    Information included in correspondences with the Individual, and the content of inquiries, requests, and feedback (including their causes and solutions), etc.
  • (3) IT and system data, including usage status of the Foundation’s website:
    Information on how the Individual uses the Foundation's website, including cookies and activity logs on the website, etc.
3. Disclosure and Provision to Third Parties

The Foundation will not disclose or provide the Individual's personal information to third parties. Note that the provision of personal information to contractors within the scope of outsourcing business operations does not constitute disclosure or provision to third parties.

4. Joint Use

The Foundation does not jointly use the Individual's personal information.

5. Management of Personal Information

In taking custody of the Individual's personal information, the Foundation implements appropriate management and exercises the utmost care to prevent leakage, loss, falsification, etc.

6. Requests Regarding the Handling of Personal Information

When the Foundation receives a request from the Individual regarding personal information maintained in the Foundation's database for disclosure, correction, deletion, addition, suspension of use, or erasure (hereinafter collectively referred to as "Disclosure, etc."), the Foundation shall, after verifying that the requester is the Individual themselves, respond in accordance with applicable laws and regulations within a reasonable period and scope.

The method for Disclosure, etc. shall be determined based on the Individual's preference, such as in writing or via electronic records. Please note in advance that for notifications of the purpose of use and disclosures, the Individual will be required to bear the actual costs necessary for the procedure (such as postage). If the request does not meet the requirements stipulated by laws and regulations, or if there are grounds permitted by laws and regulations to refuse Disclosure, etc., the Foundation may not be able to accommodate the request.

8. Changes to the Privacy Policy

The Foundation may change this Privacy Policy. In the event that this Privacy Policy is changed, it will be posted on the Foundation's website (https://gendai-art.org). Please carefully review the updated content.

EEA Privacy Policy

This EEA Privacy Policy explains the handling of personal information of Individuals located in the European Economic Area (hereinafter referred to as "the EEA") based on the EU General Data Protection Regulation 2016/679 (hereinafter referred to as "the GDPR").
In the event of any conflict between the provisions of the main Privacy Policy and this EEA Privacy Policy, the provisions of this EEA Privacy Policy shall prevail.

1. Legal Basis for Processing Personal Information

Under the GDPR, the Foundation protects the Individual's personal information by processing it only within the scope necessary for specific purposes (as described in Section 1 of the Privacy Policy).

The Foundation processes the Individual's personal information based on one of the following legal bases:
  • (1) Consent: Where the Individual has given consent to the processing.
  • (2) Performance of a Contract: Where processing is necessary for the performance of a contract or to take steps prior to entering into a contract. This usually serves as the basis for processing the Individual's identity data, contact information, and other information necessary for the Foundation to operate its business.
  • (3) Legal Obligation: Where processing is necessary for compliance with a legal obligation to which the Foundation is subject. This includes sharing personal information with law enforcement agencies and legal obligations toward the Individual or the Foundation's employees.
  • (4) Vital Interests: Where processing is necessary to protect the vital interests of the Individual or another natural person.
  • (5) Legitimate Interests: Where processing is necessary for the purposes of the legitimate interests pursued by the Foundation or a third party, except where such interests are overridden by the Individual's rights under data protection laws. This includes the maintenance, development, and improvement of the Foundation's services, as well as the use of personal information necessary to operate the Foundation's business.
2. Requests Regarding the Handling of Personal Information

The Individual has the following legal rights regarding the personal information acquired and processed by the Foundation. To exercise these rights, please contact the Inquiry Desk listed in Section 8 below.

  • (1) Right of access
  • (2) Right to rectification and update
  • (3) Right to erasure (right to be forgotten)
  • (4) Right to data portability
  • (5) Right to object to processing
  • (6) Right to restriction of processing
  • (7) Right to withdraw consent
Please note that the rights listed above are not absolute and may not apply to all situations. Furthermore, depending on the circumstances, statutory exceptions may apply, and in such cases, the Foundation may refuse the request.
3. Sharing of Personal Information

The Foundation does not share personal information with third parties.

4. Direct Communication

The Foundation distributes information from time to time to keep the Individual informed of news and details of its operations. If the Individual does not wish to receive such information, please contact the Inquiry Desk listed in Section 8 below.

5. Location of Personal Information Storage

The Foundation is located in Japan. Japan has received an adequacy decision from the European Commission, recognizing that it ensures an adequate level of protection for personal information.

6. Retention Period of Personal Information

The Foundation retains personal information only for the period necessary to achieve the purposes for which it was collected and processed. The specific retention period is determined by taking into account the purpose of collection and processing, the nature of the personal information, and the legal or business necessity to retain the personal information.

7. Lodging a Complaint with a Supervisory Authority

The Individual has the right to object to the processing of personal information relating to them by lodging a complaint with the data protection authority competent for their place of residence.
